Terms of Service

These Terms of Service (the "Terms") are an offer by not specified (registration No. not specified, the "Provider") to enter into an agreement for access to the application programming interface (API) of the Example AI service at https://demo-en.alexshkarupa.com (the "Service") on the terms below.

1. Definitions

  • API — the Service's programming interface through which the Client sends requests to AI models and receives the results.
  • Client — a person or company that has registered with the Service and accepted these Terms.
  • Access key — a unique string that identifies the Client when calling the API.
  • Token — the unit used to measure the amount of processed text or data, on which billing is based.
  • Channel — a way of accessing a model, shown in the Service by number ("Channel 1", "Channel 2", etc.).

2. Subject of the Terms

The Provider gives the Client access to the API to call AI models, and the Client pays for the volume actually used under per-token pricing. The Provider may change the available models and channels, limits and prices by publishing up-to-date information on the website.

Models are supplied by third parties, who may stop or change their support without prior notice. The Provider is not responsible for such decisions and may, for that reason, stop or change the provision of a particular model or channel.

3. Registration and access keys

  • Using the API requires registering with an email address and creating an access key.
  • The Client must provide accurate information.
  • The Client keeps access keys confidential and is responsible for all requests made with them.
  • If a key is compromised, the Client must revoke it in the dashboard immediately and notify the Provider.

4. Balance and billing

  • Services are provided within a prepaid balance. When the balance runs out, API access is suspended until it is topped up.
  • Charges are deducted from the balance as the Service is used, based on the chosen model, channel and number of processed tokens. Current prices are published on the Pricing page.
  • The balance is topped up by the methods the Provider shows in the dashboard. The balance is not money and can only be used to pay for the Service.
  • Rate limits may apply to an account and its keys.

5. Acceptable use

The Client agrees not to use the Service to break the law, create malicious software, send spam, infringe the rights of others, or attempt to circumvent the Service's limits or gain unauthorised access to it. The Provider may suspend the Client's access if these terms are breached.

6. Generated output

Model output is produced automatically and may contain inaccuracies. The Client checks the output before using it and is responsible for how it is used. Rights in the output generated at the Client's request belong to the Client to the extent permitted by law.

7. Liability

The Service is provided "as is". The Provider does not guarantee uninterrupted operation of every model and channel. The Provider's total liability is limited to the amount the Client paid for the Service during the one month before the event giving rise to the claim.

8. Personal data

The Client's personal data is processed in accordance with the Privacy Policy published at https://demo-en.alexshkarupa.com/legal/privacy.

9. Acceptance, term and changes

Registering with the Service is acceptance of these Terms. The agreement remains in force until terminated by either party. The Provider may change the Terms by publishing a new version on the website; continuing to use the Service after publication means acceptance of the new version.

10. Refunds

The unused balance is refunded upon the Client's written request sent to ipalexshkarupa@yandex.ru, less the cost of services already provided.

11. Governing law and disputes

These Terms are governed by the laws of the country where the Provider is registered. The parties will first try to resolve any dispute by negotiation; a written claim must be answered within 30 days. Disputes that cannot be settled are resolved by the competent courts at the Provider's place of registration.
